These Terms of Service ("Terms") set out the conditions on which puniq UG ("puniq", "we", "us") makes its website at puniq.de and puniq-intelligence.com (the "Site") and related information available to you. By accessing or using the Site you accept these Terms. If you do not accept them, please do not use the Site.
puniq UG is a company registered in Berlin, Germany. Full identifying details are set out in our Impressum. How we handle personal data is described in our Privacy Policy.
1. Use of the Site
You may view, browse and use the Site for your own lawful, non-commercial information purposes, and to evaluate or contact puniq about its services. In return you agree that you will not:
- use the Site in any way that breaches applicable law or regulation, or that is fraudulent or harmful;
- attempt to gain unauthorised access to the Site, its servers, or any system or network connected to it;
- introduce malware, scrape at scale, or otherwise interfere with the proper working of the Site;
- reproduce, resell or commercially exploit any part of the Site without our prior written consent.
We may suspend, withdraw or restrict access to all or part of the Site for operational, security or legal reasons, without notice. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted.
2. Our services
The Site describes the services puniq offers, including the Data Auditor, the Infrastructure Blueprint, and our AI Optimization subscription. The Site itself is informational. It does not constitute an offer, a quotation, or a binding commitment. Any engagement is governed by a separate written agreement signed by both parties, and in the event of a conflict that agreement prevails over these Terms.
Our AI Optimization output is advisory only and operates with a human in the loop. It supports decisions, it does not replace your judgement, and it does not control building systems autonomously.
It is provided to support the work of you and your qualified engineers, not to act in their place.
3. Intellectual property
All content on the Site, including text, graphics, logos, the puniq name and marks, software, layout and the Documented Data Map methodology, is owned by or licensed to puniq and is protected by copyright, trademark and other intellectual property laws. These Terms do not transfer any of these rights to you.
You may not copy, modify, distribute, publish or create derivative works from Site content except as expressly permitted by these Terms or with our prior written permission. Where we make a tool, template or guide available for download, you may use it only on the terms presented with it.
4. No warranty for informational content
The Site and its content are provided "as is" and "as available". While we apply genuine engineering care to what we publish, the Site is general information and is not professional, legal, regulatory or technical advice for your specific building or situation.
To the fullest extent permitted by law, puniq makes no representations or warranties, express or implied, that the content is accurate, complete, current, fit for a particular purpose, or free of error. Regulatory references such as GEG, the EU Taxonomy, CSRD or the EU Data Act are summarised for context and may change. You should not act, or refrain from acting, in reliance on Site content without taking appropriate professional advice.
5. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for injury to life, body or health caused by our negligence, or liability under the German Product Liability Act (Produkthaftungsgesetz).
Subject to that, puniq is liable without limitation only for intent and gross negligence. For ordinary negligence we are liable only where we breach a material contractual obligation (an obligation whose fulfilment makes proper performance possible and on whose observance you may reasonably rely), and in that case our liability is limited to the foreseeable damage typical of this kind of relationship.
To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, loss of data, or business interruption arising from your use of, or inability to use, the Site or any content on it.
6. Third-party links
The Site may link to third-party websites, including those of our partners and clients. We provide these links for convenience only. We do not control and are not responsible for the content, accuracy or practices of any third-party site, and a link does not imply endorsement.
7. Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, our practices, or the law. The version published on the Site is the version in force. We will indicate the date of the latest revision below, and continued use of the Site after a change takes effect means you accept the updated Terms.
8. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
Where you are a merchant, a legal entity under public law or a special fund under public law, the courts of Berlin, Germany shall have exclusive jurisdiction over any dispute arising from these Terms. Mandatory consumer protection provisions of your country of residence remain unaffected.
9. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is replaced by a valid one that comes closest to the original intent.
